Expert solicitors are necessary because few members of the public have the skills to place a complex legal argument with evidence that is compelling and makes assertions of the balance of probabilities. The Act, the CICA’s interpretation and goal is a one-way street that institutionally victimizes the crime victim, or dependents. It is ultimately a glorified social security service without the same level of accountability, or efficiency. Many solicitors and crime victims find dealing with the CICA and their process intolerable. There is no provision for getting the free expert legal service automatically offered to a violent criminal - applicants pay for legal representation from their compensation award, or from some other private means, or trade union.
Undertaking criminal injury compensation cases is not particularly attractive work for solicitors. It involves a considerable amount of work dealing with an aloof and shambolic agency (CICA) for little profit for the solicitor; especially since the introduction of the 1995 Act and its tariff-based injury scoring system.
